1. Acceptance of These Terms

These Website Terms of Use (“Terms”) govern your access to and use of www.njfpl.org and any other website page or online feature that links to these Terms (collectively, the “Website”). The Website is operated by New Jersey Family Planning League (“NJFPL,” “League,” “we,” “us,” or “our”). By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

We may update these Terms from time to time. Changes are effective when posted unless a different effective date is stated. Your continued use of the Website after changes are posted means you accept the updated Terms.

2. Informational Website Only

The Website provides general information about NJFPL, reproductive and sexual health resources, family planning services, abortion care resources, health center locations, public education, and related topics. The Website is for informational and educational purposes only.

The Website does not provide medical advice, diagnosis, treatment, counseling, legal advice, or emergency services. Information on the Website may not apply to your individual medical, legal, geographic, financial, or personal circumstances. You should consult a qualified health care provider, attorney, or other appropriate professional for advice specific to your situation. If you are experiencing a medical emergency, call 911.

3. No Medical Care or Provider-Patient Relationship

NJFPL does not provide medical care through the Website. Your use of the Website, including reading Website content, using a health center locator, contacting NJFPL through a form or email, or clicking a provider link, does not create a patient-provider relationship, physician-patient relationship, therapist-client relationship, attorney-client relationship, or confidential medical relationship with NJFPL.

Health centers, hospitals, federally qualified health centers, Planned Parenthood affiliates, abortion care centers, community health centers, and other providers referenced on the Website are independent organizations. They are responsible for their own services, professional judgment, appointments, medical records, privacy practices, billing, insurance, licensing, and compliance obligations. NJFPL does not guarantee that any provider will accept you as a patient, provide any specific service, offer any specific appointment, accept any insurance, charge any particular amount, or provide care in any particular manner.

4. No Solicitation of Unlawful Services

The Website includes information about services and resources that may be legally available in New Jersey or through independent providers where legally permitted. Nothing on the Website is intended to offer, provide, prescribe, ship, arrange, solicit, encourage, aid, abet, or facilitate any health care service, medication, or procedure in any jurisdiction where doing so would be unlawful.

Laws regarding abortion, telehealth, medication, confidentiality, parental involvement, insurance, travel, and related matters vary by jurisdiction and may change. Provider listings and links do not constitute medical advice, endorsement, certification, guarantee, or warranty. NJFPL may update, remove, or modify listings at any time.

The Website may include contact forms, search fields, comment fields, email links, newsletter sign-ups, job application instructions, or other interactive features. You use these features at your own risk. Website text fields and email are not intended for medical care, clinical questions, appointment scheduling, urgent requests, protected health information, or sensitive personal information.

DO NOT SUBMIT sensitive health information, abortion-related information, reproductive or sexual health information, immigration status, precise location, government identification numbers, financial account information, or other sensitive information through Website forms, comments, email links, or other free-text fields. If you need medical advice, care, or an appointment, contact a health center directly. If you submit information through the Website despite this warning, you do so at your own risk, and NJFPL may use the information to review and respond to your communication, route your request as directed by you, protect rights or safety, comply with law, and maintain appropriate records.

7. User Submissions

If you submit comments, messages, feedback, suggestions, application materials, or other content through or in connection with the Website (“Submissions”), you represent that you have the right to submit the information and that your Submission does not violate any law or third-party right. You agree not to submit content that is unlawful, threatening, abusive, harassing, defamatory, invasive of privacy, obscene, discriminatory, infringing, misleading, malicious, or otherwise inappropriate.

You should not submit information that you consider confidential, proprietary, or sensitive unless a specific secure channel has been provided for that purpose. Subject to our Privacy Policy and applicable law, you grant NJFPL a nonexclusive, royalty-free, worldwide license to use, reproduce, modify, display, and distribute your Submissions as reasonably necessary to operate the Website, respond to you, consider your request or application, protect rights and safety, comply with law, and carry out NJFPL’s mission and operations.

NJFPL names, logos, and related marks may not be used without prior written permission. Third-party names, logos, and marks belong to their respective owners.

Use the Website for any unlawful, fraudulent, harmful, harassing, abusive, or misleading purpose;
Attempt to gain unauthorized access to the Website, servers, systems, accounts, or data;

THE WEBSITE AND ALL WEBSITE CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NJFPL DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, RELIABILITY, AVAILABILITY, SECURITY, AND ERROR-FREE OPERATION.

NJFPL does not warrant that Website content is current, complete, accurate, uninterrupted, secure, or free of errors, viruses, or harmful components. Health care information, provider information, laws, service availability, and costs may change without notice.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NJFPL AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, GRANTORS, SERVICE PROVIDERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR ENHANCED DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, SERVICE INTERRUPTION, COMPUTER DAMAGE, SECURITY INCIDENTS, PERSONAL INJURY, OR OTHER DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE WEBSITE, WEBSITE CONTENT, THIRD-PARTY LINKS, PROVIDER LISTINGS, OR USER SUBMISSIONS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NJFPL’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE WEBSITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

14. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless NJFPL and its directors, officers, employees, agents, contractors, service providers, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to your violation of these Terms, misuse of the Website, Submissions, violation of law, or infringement of any rights of another person or entity.

16. Governing Law and Venue

These Terms and any dispute arising out of or relating to the Website will be governed by the laws of the State of New Jersey, without regard to conflict-of-law principles. To the maximum extent permitted by law, you agree that any action or proceeding arising out of or relating to the Website or these Terms will be brought only in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.

17. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. These Terms, together with any policies linked from the Website, constitute the entire agreement between you and NJFPL regarding the Website.
